Paternity leave for public servants in Rio de Janeiro is extended to 30 days




Civil and military public servants in the state of Rio de Janeiro are now entitled to 30 days of paternity leave – and no longer five working days, as provided for in the Federal Constitution. The new duration of paternity leave will also apply in the event of a stillbirth (when the baby is born dead) or if he is born and subsequently dies.


Another major social advance of the Constitutional Amendment is the change in the length of maternity leave for mothers of premature babies, which now begins when the baby is discharged from the Intensive Care Unit, and the provision for maternity leave of 120 days even in case of pregnancy loss. The right to leave for pregnant women extends to all civil servants on a CLT, employees of state public companies, state foundations and all public servants in the State of Rio de Janeiro, regardless of the employee's type of employment.


Constitutional Amendment 63/2015, authored by state deputies Marcelo Freixo, Ana Paula Rechuan, Enfermeira Rejane, Tia Ju, Martha Rocha, Daniele Guerreiro and Flavio Serafini, was approved unanimously, with 56 votes in favor, in the session of the Legislative Assembly of the State of Rio de Janeiro on December 21st, and published on December 22nd, in the Official Gazette.


Promundo, together with the National Early Childhood Network, defends the expansion of paternity leave nationally. We celebrate and congratulate the state deputies who participated in voting on this important advance, fundamental for the development of young children.
